COPYRIGHTS / LITERARY AND ARTISTIC WORKS

The copyright is the right protected under the Law on Intellectual and Artistic Works numbered 5846 on the works that the person forms with all kinds of intellectual labor.

  • Copyrights are started to be protected by the formation of the work but copyrights should be registered in order to prove the rights and facilitate the proof and to provide more clear protection on the 3rd persons.
  • The copyrights are abstract. Rights such as human thought, opinion etc. protected by copyrights are non-material rights. The copyright has a separate and independent asset and legal value from the material it embodies.
  • Copyrights are specific to countries, and protection is required within the legislation of the country in which protection is requested.
  • Copyrights have absolute rights.
  • The copyrights are protected for a certain period of time.

ARTISTIC WORKS;

In order for an idea and an art product to be accepted as an artistic work in the frame of the law numbered 5846,

  • It shall be the result of an intellectual effort.
  • It shall be characterized by the owner.
  • It shall be shaped.
  • It must be in the qualities that are considered to be artistic works.

RIGHTS OF THE COPYRIGHT OWNERS

BCopyright owner is the party who creates the work and copyright owners have Moral and Material Rights on the work.

Moral Rights;

  • Right to present to public
  • Right to mention his/her name
  • To ban the amendment of the work
  • Rights over the possessor of the work

Material Rights;

  • Right to work
  • Right to reproduce
  • Right to publish
  • Right to represent
  • Right of submission

The owners of the works and their heirs can transfer their financial rights mutually or without compensation, periodically or indefinitely. The contract for financial rights must be written and a separate breakdown of the issue must be provided.

COPYRIGHT REGISTRATION
